“You’ve got a terrible record of using drugs,” magistrate Robert Rabbidge told James Gordon Clayton when he appeared at the Forbes Local Court on July 6 this year.

Clayton, 35, of Patterson Street, Forbes was before the court charged with possessing 3.82 grams of cannabis.
“This is the fifth time you’ve come before the courts in six months, it’s bordering on ridiculous,” Magistrate Rabbidge told Clayton.
He entered a plea of guilty to the offence, was fined $300 and placed on a Section 9 bond to be of good behaviour for 12 months.
Clayton was charged with the latest offence after police observed him leaving a vehicle parked in Farnell Street one night earlier this year.
It was about 10.40pm on Monday, June 6 when Clayton came to police attention.
According to police facts tendered to the court, police spotted a vehicle parked at the intersection of Farnell Street and Quarry Road in Forbes.
According to the facts Police who were patrolling in Forbes that night drove up behind the vehicle and noticed that it’s engine was running and a female was in the driver’s seat.
At this time, the accused, Clayton, walked out of the front door of a house in Farnell Street where he had been visiting a friend and sighted the police.
Clayton then placed his left hand in his pocket and jumped into the front passenger seat of the vehicle police had observed.
At this time police activated their vehicle’s warning devices and approached the driver’s side of the vehicle, speaking to the driver.
Police then spoke with Clayton who identified himself as the owner of the vehicle.
Clayton then exited the vehicle and was asked if he had anything in his possession.
He freely handed over two tissues to police containing what appeared to be cannabis.
Police asked Clayton who owned the cannabis and he admitted it was his and that he bought it with him when he visited his friend.
Clayton then attended the Forbes Police Station where he viewed the drug being weighed and the weight was revealed to be 3.82 grams.
When he was assumed of the weight Clayton said “I guess so”.
Police said Clayton was polite and compliant with them at all times.
They said there was no attempt to deny possession or ownership of the drug and he was co-operative with them at all times.
If Clayton reoffends within 12 months his bond will be revoked.
