Police stopped the driver for a random breath test in Wambat Street shortly after midnight on Sunday morning.
He returned a positive sample roadside and on return to Forbes Police Station and will face Forbes Local Court.
A 36-year-old man was charged with failing to provide a sample for a breath test.
The man was stopped in Forbes about 9pm Sunday and failed to provide a sample for the random breath test or on return to the station.
Police also found his car was unregistered and have issued infringements for driving unregistered and uninsured.
Police have praised the behaviour of crowds attending Forbes camel races.
Across the state, there was tragedy on the roads on the Easter weekend. At time of print, three people had been killed in separate crashes.
Police had attended 216 major crashes, issued 4726 speed infringements and 150 drink drive charges in three days.
